Frequently asked questions

The most common questions I hear from clients and their families. If yours isn't here, call me — the consultation is free.

Facing a criminal case raises many questions, especially the first time. These are the ones I'm asked most. No answer replaces a consultation about your specific case, but they'll give you a starting point.

Is the first consultation free?

Yes. The first consultation is free and confidential. I explain your situation clearly, without jargon, so you can make an informed decision.

Do you speak Spanish?

Yes. Spanish was my first language. I handle your case and explain everything in Spanish or English, and you deal directly with me, not an intermediary.

How much does a criminal defense lawyer cost?

It depends on the type of case and its complexity. We discuss it clearly in the free consultation, with no surprises. What matters is that you understand what the representation includes before deciding.

A family member was arrested. What do I do?

Call me as soon as possible with the full name and the place of detention if you have it. Tell your family member to stay silent and not discuss the case by phone, because those calls are recorded.

Can a criminal case affect my immigration status?

Yes, even a misdemeanor can carry serious immigration consequences. That's why I defend your case with your status in mind from day one.

What's the difference between a misdemeanor and a felony?

A misdemeanor carries up to a year in jail; a felony can mean more than a year in prison and far greater consequences. Getting the charge classified correctly is key.

What's the difference between a state case and a federal case?

Federal cases usually involve agencies like the FBI or DEA, larger amounts or multiple people, and carry harsher penalties. I handle both systems.

Do I have to go to trial?

Not necessarily. Most cases resolve through dismissals, diversion programs, or agreements. Trial is used only when it serves your case.

Can I seal or expunge my record?

In many cases yes, if the outcome and your history allow it. Sealing or expunging a record can help you regain employment and peace of mind. We evaluate it based on your case.

What if I can't afford bond?

There are options. At the first appearance and, in serious charges, at a separate hearing, you can argue for a lower bond or release conditions. Stepping in early helps.

Do you handle cases throughout Miami-Dade?

Yes, I handle cases throughout Miami-Dade County, in both the state courts and the federal court for the Southern District of Florida.

When should I hire a lawyer?

As soon as possible. If you've been arrested, before the first hearing. If you know you're being investigated, even before charges exist. The sooner I step in, the more I can do.
