TIME SERVED FOR CLIENT ACCUSED OF BEING A FELON IN POSSESSION OF A FIREARM AND POSSESSING WITH INTENT TO DISTRIBUTE MARIJUANA

Erick Cruz negotiates a one-day time-served sentence for clients charged as being a convicted felon with a gun and possessing with intent to distribute marijuana. The client had been under surveillance by police officers after they received a tip that the client was selling drugs and carried with him a gun.  The officers observed the client get into a car and drive off.  The officers stopped the car and obtained his permission to search his house.  Inside the house, the officers found several baggies containing marijuana, a scale, a large amount of cash and a gun.  The client also gave a recorded statement accepting responsibility for the gun and for selling drugs.  Because the client was a convicted felon, he was not allowed to own or possess a firearm and he was charged with being a felon in possession of a gun and possessing with intent to distribute marijuana.

Initially, the prosecutors insisted on a three-year prison sentence for the client.  The client came to see Erick to represent him and negotiate a lower for him.  Erick got to work on the case by ordering the police dispatch communications that showed that the initial reason for the stop was invalid.  Erick also obtained the client's criminal history that revealed that his last conviction was over 10 years old and he had since obtained a job, started a family and was on the right course.  Using all of this information Erick made a presentation to the prosecutor and negotiated a one day sentence for his client.  The client was very satisfied with the outcome because he avoided a three year prison sentence and any time on probation.
