MEDICAL PROFESSIONAL PLEADS TO A REDUCED COUNT AND AVOIDS JAIL AND SEXUAL OFFENDER REPORTING REQUIREMENTS

A medical professional accused of sexual battery against his patient avoided the stigma of having to report as a sexual offender and avoids having to serve any jail time. The professional was accused of entering his patient’s room and fondling her against her will. The prosecutors used DNA evidence to link him to the crime. Initially, the prosecutors wanted the client to plead to a sex offense, serve jail time and be designated a sex offender.

After carefully mapping out the client’s defense, Erick was able to identify deficiencies in the evidence and mistakes in the application for a search warrant. Erick also directed the client to seek a mental health evaluation that demonstrated that the client was not a danger or threat to the community. Erick was able to use these points as leverage to negotiate a resolution that allowed the client to plead to a non-sex offense, avoid having to serve any jail time and not have to register as a sex offender.
