MAN CHARGED WITH TRAFFICKING IN MARIJUANA RECEIVES HOUSE ARREST AND PROBATION

Police officers received a tip that a man was growing marijuana inside his house.  The police officers surrounded the man's home and waited for him to exit the house.  When he stepped out of the house, the officers approached him and asked him for permission to search his house.  The man gave the officers permission to search his house, but surprisingly, they did not find any drugs.  One of the officers, however, walked around the property and searched a detached garage.  Inside the garage, the officer found a fully functional marijuana grow laboratory containing over 100 pounds of marijuana.  The man confessed to growing the marijuana and was arrested and charged accordingly.

Initially, the man was represented by another attorney and the plea offer that the prosecutors made to him was a three-year minimum mandatory prison sentence.  Not satisfied with the results he was getting, the man hired Erick Cruz to take over his defense.  Immediately, Erick began investigating the case and researching the law applicable to the case.  Erick took the deposition of the officers that revealed inconsistencies and deficiencies in their testimony.  Erick presented these issues to the prosecutor in a motion to suppress the evidence.  After reviewing the motion to suppress, the prosecutor agreed to reduce the sentence and agreed to house arrest and probation.  With good behavior, the defendant's probation could end in two years.

This case presents a good example that while these cases usually seem defenseless, there are many aspects that can lead to evidence being suppressed or having the charges and sentence reduced.
